55-year-old Daniel Walter Setzer of Hudson was convicted this week in Caldwell Co. Criminal Superior Court for felony statutory rape of a person 13,14, or 15 years old and indecent liberties with a child. The jury deliberated for about an hour before returning the guilty verdicts. Setzer was sentenced to no less than 253 months and no more than 313 months in the North Carolina Division of Adult Correction.
Upon his release from prison, Setzer will be required to register with the North Carolina Sex Offender Registry for life and will be subject to lifetime satellite-based monitoring.
The crime occurred in October 2009 and was investigated by Detective Shelly Hartley of the Caldwell County Sheriff’s Office. The victim was the 15-year-old girlfriend of Setzer’s son. Setzer was already on probation as the result of a 2004 conviction in Burke County for molesting his nine-year-old daughter.
Assistant District Attorney David Swanson prosecuted the case and the Honorable Marvin Pope presided over the conviction.
Setzer will be transported to the Division of Adult Correction for processing.
